The Ninth Circuit Court of Appeals ruled that NFTs can be considered "goods" under the Lanham Act, and thus are eligible for trademark protection. The court dismissed most of the legal defenses put forth by artist Ryder Ripps, but simultaneously overturned the previous judgment of $9 million in damages and injunction, remanding the case to the district court for a new trial to determine whether ordinary consumers are likely to confuse his RR/BAYC series with the genuine products of Yuga Labs.
